These are our Terms and Conditions of Sale. In them we use certain words and expressions to mean specific things, as follows:
"We", "us", "our" means Austen Group Limited, trading as BirdSeed.co.uk, a company registered in England and Wales. Our company registration number is 13894109, and our registered office is at Unit 5 Babdown Industrial Estate, Babdown, Tetbury, Gloucestershire, GL8 8YL.
"You", "your" refers to you, our customer who is purchasing products ("Goods") from us through birdseed.co.uk ("our site"), subject to the following terms and conditions ("Conditions"). The expression "writing" includes emails.

Access and Use of Our Site

These Conditions only apply when you buy products directly from us. They do not apply where you have purchased a product through a third-party website, in which case any contract is between you and that third party.

Access to our site is free of charge. We may alter, suspend or discontinue our site (or any part of it) at any time without notice, and we won't be liable to you if our site is unavailable at any time.

You must be 16 or over to purchase, register, sign up for our newsletter, or submit contact forms through the site.
Our Contract

When we confirm to you in writing that we can supply the Goods you've ordered ("Order Confirmation"), a contract comes into force between you and us ("Contract"). Each order forms a separate Contract.

Please check your order carefully before submitting it to make sure it's complete and correct.

If we're unable to accept your order — for example because an item is out of stock, or we've identified a pricing or description error — we'll let you know and won't charge you for the Goods. Any payment already taken will be refunded in full.
Goods, Pricing and Payment

Product images are for illustration only. While we make every effort to describe our products accurately, including pack sizes and weights, actual packaging may vary slightly.

We take reasonable care to ensure prices shown on our site are correct and inclusive of VAT where applicable. We reserve the right to change prices and run promotions from time to time.

Payment must be made in full at the time of ordering. We won't dispatch Goods until payment has been received.
Delivery, Risk and Ownership

We'll deliver your Goods in line with our Delivery Information page. Delivery estimates are just that — estimates — and may be affected by circumstances outside our control.

Risk in the Goods passes to you once they're delivered to the address you provided at checkout, and ownership passes once we've received payment in full.
Faulty, Damaged or Incorrect Goods

If your order arrives faulty, damaged or different from what you ordered, please contact us as soon as possible — ideally within 48 hours of delivery — with details and, where possible, photographs. See our Returns Policy for how we'll resolve this.
Ending the Contract

As you're buying online, you have the right to change your mind within 14 days of receiving your order, subject to the conditions set out in our Returns Policy — in particular, because our products are foodstuffs, unopened bags and tubs can be returned but opened ones generally can't.
Our Liability

We're responsible for loss or damage you suffer as a foreseeable result of us breaking this Contract or failing to use reasonable care and skill, but we don't exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud.
Other Important Terms

This Contract is between you and us; no one else has any right to enforce its terms.
(16)
If a court decides part of these Conditions is unlawful or unenforceable, the rest will remain in full force.
(17)
These Conditions are governed by English law, and legal proceedings can be brought in the English courts (or, if you live in Scotland, the Scottish or English courts).
